The petitioner seeks bail in connection with Mahnar P.S. Case No. 277 of 2017 for offences punishable under Sections 363 and 365 of the Indian Penal Code.
The allegation against the petitioner is regarding abducting the victim girl.
Learned counsel for the petitioner, referring to the statement of the victim made under section 164 Cr.P.C., has submitted that the victim girl has not stated about any untoward incident having been committed by the petitioner herein. Learned counsel for the petitioner further submits that as far as the petitioner is concerned, there is no allegation of either forcibly taking away the victim girl
Patna High Court Cr.Misc. No.28504 of 2018 (2) dt.09-05-2018 2/2 or assaulting her sexually. The learned counsel for the petitioner submit that the petitioner is languishing in custody since 08.12.2017 and he is having a clean antecedent. Having regard to the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bon of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahnar P.S. Case No. 277 of 2017.
