Mr.Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 08-06-2020 Heard the learned counsel for the petitioner and Mr. Dashrath Mehta, the learned Additional P.P. for the State through video conferencing.

The petitioner seeks bail in Saharsa Sadar (Sonbarsa Kachahari) P.S. Case No.511 of 2019, registered under Sections 399, 400, 401, 402, 411, 414 and 412 of the Indian Penal Code and under Sections 25(1-b)A, 26, 35 of the Arms Act. The informant after having received information that some criminals had assembled to commit cognizable offence, raided the place and apprehended the petitioner and many other persons. From possession of the petitioner one loaded country made pistol was recovered. From possession of other persons also arms and ammunitions along with stolen vehicles and other

Learned counsel for the petitioner submits that the petitioner is in jail since 06.06.2019. the petitioner has remained in jail for more than a year. Similarly situated other co-accused persons, namely, Ajit Kumar, Subodh Kumar, Manish Yadav @ Ugen Yadav and Krishna Kumar @ Krishna Yadav have already been granted bail.

Taking into consideration the fact that the petitioner is in jail for more than a year, petitioner, namely, Binit Kumar @ Vinit Kumar is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saharsa in connection with Saharsa Sadar (Sonbarsa Kachahari) P.S. Case No.511 of 2019.
