This application is for grant of regular bail in connection with Gopalpur (Rangra) P.S.Casae No.154 of 2017 (G.R.Case No.3126 of 20-17) for the offences punishable under Sections 20/22 of the N.D.P.S. Act.
Allegation against the petitioner is about recovery of 23 kg. of ganja from the tempo and the petitioner was arrested from the tempo.
Submission of the learned counsel for the petitioner is that he is neither owner of the tempo nor driver of the same and he has nothing to do with the aforesaid seized articles and he is in custody for about four months. He has no criminal antecedent. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.50568 of 2017 (2) dt.13-11-2017 2/2 Having heard both sides and in view of fact that he was arrested on the spot and there is recovery of 23 kg. of ganja, as such I am not inclined to grant bail to the petitioner, as such the prayer for bail of the petitioner is rejected, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.
With the aforesaid observation, this application is dismissed.
