JUSTICE BIRENDRA KUMAR ORAL ORDER 31-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections-467, 468, 471,406, 419 & 120(B) of the Indian Penal Code and Section 3 of Bihar Protection of Interest of Depositors Act 2002. Company named as Bhartiya Saakh & Bachat Cooperative Society Ltd. allegedly cheated the informant. Allegation is that the petitioner and others had persuaded different person to deposit money with the company.
Submission of the learned counsel for the petitioner is that in fact the petitioner is also a victim as the petitioner and his family members had deposited money with the said company vide
Patna High Court Cr.Misc. No.29399 of 2018 (2) dt.31-05-2018 Annexure-2 series. The petitioner was not an office bearer of the said company ever. The co-accused namely, Divakar Mehta who was father of the petitioner has already been allowed regular bail by this court by order dated 29.01.2018 passed in Cr. Misc. No. 5079 of 2018.
Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the Court below where the case is pending in connection with Simri P.S. Case No. 146 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which, the court below shall be at liberty to cancel the bail bond of the petitioner.
