2. The petitioner has preferred this application for grant of regular bail in connection with Asarganj P.S. Case No. 159 of 2024 dated 21.11.2024 registered for the offences punishable u/ss 126(2), 115(2), 109(1), 352, 351(2), 351(3) read with section 3(5) of the BNS.

3. As per the prosecution case, when the informant along with his mother was working in the field, in the meantime, the petitioner and the co-accused person came there and assaulted him due to irrigation dispute causing injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to previous injury. The allegation against the petitioner is of

Patna High Court CR. MISC. No.14673 of 2025(2) dt.21-03-2025 2/2 assaulting the informant with the fists. The informant sustained grievous injury caused by hard and blunt substance. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 04.01.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that there is specific allegation against the petitioner and the injury of the informant is stated to grievous in nature.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Munger in connection with Asarganj P.S. Case No. 159 of 2024, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.

7. The application stands allowed.
