Petitioner, already in custody, seeks bail in connection with Sasaram (M) PS Case No.1397 of 2016, giving rise to Sessions Trial No.458 of 2017, registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as other co-accused have been admitted to bail by this Court as well as by another co-ordinate Bench of this Court vide Cr. Misc. Nos.62023 of 2017, 8801 of 2018 and 16419 of 2018 on 17.02.2018, 15.02.2018 and 22.03.2018, besides this, submission on the merit is that except confessional statement, there is no other material, neither he was put on TIP nor any incriminating material was recovered from

Patna High Court Cr.Misc. No.29196 of 2018(2) dt.11-05-2018 2/2 his possession.

Having considered the aforesaid facts and circumstances, petitioner Kabindra Prajapati @ Kavindra Kumhar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-IV, Rohtas at Sasaram in connection with Sasaram (M) PS Case No.1397 of 2016.
