Petitioner is in custody in connection with Saharsa Sadar (Sonbarsa Kachahari) P.S. Case No. 511 of 2019 for the offence under sections 399, 400, 401, 402, 411, 414, 412 of the Indian Penal Code and Section 25(1-b) a/26/35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner would submit that in this case one loaded country made katta was recovered from the possession of the petitioner. Learned counsel further submits that similarly circumstanced co-accused namely, Subodh Kumar, Manish Kumar and Soeb Kumar @ Krishna Yadav have been granted by different benches of this court.

Considering the fact that petitioner has remained in custody for nearly one year, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa, in connection with Saharsa Sadar (Sonbarsa Kachahari) P.S. Case No. 511 of 2019 subject to the condition that on release the petitioner shall render his service as volunteer for a period of one month to combat pandemic Covid-19 and as such he is required to report to the Nodal Officer, Saharsa who shall utilize the service of the petitioner appropriately.
