2. The petitioner apprehends his arrest in a case registered for the offence under Sections 379, 411/34 of the IPC.
3. As per the prosecution case, on 08.07.2023, the tractor of the informant, bearing registration no. BR26BGB5421, was parked near the gate of Deo Hospital, but in the next morning, informant's nephew informed him about theft of tractor. During investigation, the tractor was recovered at the door of Madan Singh, which was parked by this petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. The alleged tractor has been recovered in front of the house of Madan Singh and petitioner has got no concern with the same, but co-accused Madan Singh has falsely implicated him. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad (Bihar) in connection with Dev P.S. Case No. 168 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
