The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.

As per the prosecution case, the driver of the truck was looted on the point of knife and pistol. The accused persons took away Rs. 1000/- in cash and a mobile phone and from the possession of another driver Rs. 20,000/- in cash besides other articles.

It is submitted by learned counsel for the petitioner that the FIR was registered against four unknown. Referring to the order of the learned Court below it is submitted that the name of the petitioner transpired in the confessional statement of co-accused Vikash Kumar made before police. The said

Patna High Court CR. MISC. No.26216 of 2021(2) dt.23-11-2021 2/2 Vikash Kumar has been enlarged on bail vide order dated 25.9.2019 (Annexure 2) passed in Cr. Misc. 60532 of 2019. No incriminating article has been recovered from the possession of the petitioner who is in custody since 10.12.2020 and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the period in custody together with grant of bail to co-accused Vikash Kumar, the Court directs the petitioner to be enlarged on bail in connection with Doriganj P.S Case no. 70 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra.
