The petitioner seeks bail in connection with Khaira P.S. Case No. 126 of 2018 registered under Sections 272, 273 and 34 of the Indian Penal Code and Sections 30(a) and 38(i) of the Bihar Prohibition and Excise Act, 2016.
120 liters of country made liquor and nine liters of foreign liquor are said to have been recovered from Scorpio and Xylo Jeeps and the driver, Raj Kumar, and the petitioner were apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. He has no concern either
Patna High Court Cr.Misc. No.26709 of 2018(2) dt.03-05-2018 2/2 with the seized liquor or vehicle in question. He has been falsely implicated in the case at the instance of his enemies. He happens to be simple passenger and had no knowledge of keeping the liquor in it. He has no criminal antecedent. He has been languishing in custody since 03.04.2018. Similarly situated co-accused, namely, Rajnath Nonia, has been enlarged on bail by this Court vide order, dated 01.05.2018, passed in Cr. Misc. No. 25187 of 2018.
Considering the facts, aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Khaira P.S. Case No. 126 of 2018 to the satisfaction of the Additional Sessions Judge, II, Jamui.
