The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 135 of the Electricity Act.

Allegation against the petitioner is that he was utilizing unauthorized electricity by hooking with Lt. Line. It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is now ready to pay a fine of Rs. 2,38,953/- as imposed by the Electricity Department. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application. Learned counsel for the petitioner is directed to deposit Rs. 2,38,953/- in four equal installments in the first

Patna High Court CR. MISC. No.26143 of 2021(2) dt.15-12-2021 2/2 week of every month. The petitioner shall deposit the first installment by 7th of January, 2022 and rest three installments will be deposited accordingly.

Learned APP for the State opposed the prayer for bail.

Considering the facts and circumstances of the case, the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Madanpur P.S. Case No. 200 of 2020, G.R. No. 302 of 2020, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

If petitioner fails to abide by undertaking given above, the prosecution shall be at liberty to move for cancellation of bail of the petitioner in the learned court below. (Anjani Kumar Sharan, J) devendra/- U T
