The petitioner seeks bail in connection with Kotwali P.S. Case No. 320 of 2017 for the offence punishable under Section 379 of the Indian Penal Code.
The FIR has been lodged against unknown person. Petitioner is stated to have apprehended in the present case when he was apprehended in Begusarai P.S. Case No. 537 of 2017. The learned counsel for the petitioner submits that neither any recovery has been made from the possession of the petitioner nor T.I. Parade has been conducted. It is further submitted that the petitioner is languishing in custody since 16.2.2018. Lastly, it is submitted that similarly situated co-accused person has been granted bail by a coordinate Bench of this Court
Patna High Court Cr.Misc. No.31305 of 2018 (3) dt.30-05-2018 2/2 by an order dated 01.05.2018 passed in Criminal Misc. No. 25861 of 2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Kotwali P.S. Case No. 320 of 2017.
