The petitioner is in custody since 07.03.2018 in connection with Shahpur P.S. Case No. 218 of 2017 registered under Sections 302, 201 and 120B/34 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is not named in the first information report yet on the basis of the confessional statement made before the police by one Chandu Rai, who has been named in the first information report, the petitioner is facing prosecution. It is further submitted that both the named accused persons, namely, Chandu Rai and Raju Rai have been granted the privilege of bail in Cr. Misc. No. 11479 of 2018 vide order, dated 28.02.2018, and in Cr. Misc. No. 8200 of 2018, vide order, dated 27.02.2018. It is further submitted that the statement of a co-accused made in
Patna High Court Cr.Misc. No.26733 of 2018(2) dt.14-05-2018 2/2 confession before the police has no evidenciary value and the petitioner being similarly, if not better, situated may also be given the privilege of bail.
Having learned learned counsel for the petitioner and the counsel for the State and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Shahpur P.S. Case No. 218 of 2017 to the satisfaction of the Additional Chief Judicial Magistrate, I, Danapur, Patna. (Anjana Mishra, J) Shamshad/- U T
