Counsel for petitioner is admittedly the employees of Railway and retired from service on 15.07.2005. He has granted pension by Railway and was getting his pension from P.N.B, Ara Main Branch, District- Bhojpur. The grievance of petitioner is against railway demanding genuine pension and further for payment of heavy compensation for illegal and inhuman act of respondents.

Counsel for Union of India submits that the present case is maintainable before the Central Administrative Tribunal

Patna High Court CWJC No.7764 of 2021(4) dt.10-01-2023 2/2 which is functional according to the C.A.T. Act & Rules. In this view of the matter, I am not inclined to entertain the present writ petition and application is disposed off granting the liberty to the petitioner to move before Central Administrative Tribunal within a period of six weeks from today.

With this direction, this writ application is disposed off.
