JUSTICE ARUN KUMAR ORAL ORDER 09-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 23.2.2018, seeks bail in Gardanibagh PS Case No. 52 of 2018 registered under Sections 417 and 420 of the IPC.

The allegation in brief is that in place of petitioner some other person appeared in the written examination and the LTI taken on the occasion of written test mismatched.

Learned Counsel for the petitioner submits that the report about mismatch of LTI is not from any expert rather from the agency of the biometric machine company and similarly situated co-accused have been admitted to bail by this court and coordinate Bench of this Court.

Having considered the said facts and circumstances, the petitioner, namely, Jaiwardhan Chakrawarti is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM XIV Patna in connection with Gardanibagh PS Case No. 52 of 2018.
