The petitioner is seeking regular bail in Warishnagar P.S. Case No. 97 of 2017 registered under Sections 399, 402, 414 of the Indian Penal Code read with Sections 25[1-B]AAA / 26 / 35 of the Arms Act.
Learned counsel for the petitioner submits that a perusal of the First Information Report would show that 7 persons were nabbed by the police party on the roof of the building, the allegations are that 3 persons were able to jump out from the building and fled away. It is alleged that the co-accused named those 3 persons, one of whom is the present petitioner. Learned counsel for the petitioner submits that the petitioner is having a clean antecedent and, in the present case, he has been involved
Patna High Court Cr.Misc. No.38461 of 2017 (2) dt.19-08-2017 2/2 merely on the statement of the co-accused without there being any other corroborative evidence. Nothing has been recovered from his possession nor the vehicles in question belonged to him. Learned A.P.P. accepts the factual position as appearing from the record.
In the facts and circumstances, let the petitioner, namely, Rishu Singh, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Warisnagar P.S. Case No. 97 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
