JUSTICE ARUN KUMAR ORAL ORDER 08-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 16.1.2018, seeks bail in Ara Nawada PS Case No. 35 of 2018 registered under Sections 399, 402, 120B of the IPC and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned Counsel for the petitioner submits that the recovery is said to be from the house, however there is no independent seizure list witness rather both the witnesses are police personnel, member of the raiding party, the petitioner is student of Information Technology and he is in custody for the last three months. Having considered the said facts and circumstances, the petitioner, namely, Prince Kumar @ Prince Gandhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur, Ara in connection with Ara Nawada PS Case No. 35 of 2018.
