The petitioner apprehends his arrest in Siswan P.S. Case No.05 of 2020, registered for the offences punishable under Sections 353, 385, 504 and 506 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is further submitted that from perusal of the FIR, it appears that no case is made out against the petitioner. It is submitted that the petitioner is RTI activist and he wrote application under RTI Act to CDPO, Education Officer and other department of Siswan Block for information in different dates, therefore, the concerned BDO-informant became angry and the petitioner has falsely been implicated in the case. Patna High Court CR. MISC. No.16732 of 2020(5) dt.13-12-2021 2/2 petitioner has got three criminal antecedents as stated in para 3 of the bail petition and in two cases he has been acquitted. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-IVth, Siwan in connection with Siswan P.S. Case No.05 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
