The petitioner apprehends his arrest in a case under Section 120B, 143, 147, 148, 307, 386, 447, 465, 466, 467, 468, 471/506 of the Indian Penal Code.

The informant alleged that petitioner purchased plot No. 2617 and on the basis of aforesaid sale deed the petitioner claimed to be owner of plot No. 2614, Khata No. 217, Thana No.1, Jamabandi No. 922.

It is submitted that petitioner is not concerned with plot No. 2614 and he has purchased plot No. 2617. The true facts are that earlier petitioner filed Rajeev Nagar P.S. case No. 103 of 2015 against the informant and others and that is why this false case has been filed. The informant is not owner of plot No. 2614,

Patna High Court Cr.Misc. No.16345 of 2016 (3) dt.16-05-2016 2/2 Khata No. 217 and from perusal of sale deed (Annexure-3 of the supplementary affidavit) it would appear that plot No. 2614 was sold in the name of Jai Prakash Nagar Sahkari Grih Nirman Samiti Ltd. by one Kamal Rai in the year 1983. The informant did not show any chit of paper showing the land standing in his name. Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Patna in Rajeev Nagar P.S. Case No. 141 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
