2. Petitioner seeks regular bail in a case registered for the offence punishable under sections 406 and 420 of the IPC.

3. As per prosecution case, the informant, for securing a job to his daughter in the bank, gave Rs. 4 lacs to the petitioner, but neither job was provided nor money was returned to the informant. Petitioner also threatened the informant to kill him.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He is practicing lawyer in the Hon'ble Supreme Court. There is no evidence, direct, indirect or the circumstantial, against the petitioner to show his complicity in the offence. It is also the case of the petitioner that act of securing appointment through unfair means is itself an offence and unlawful. Charge sheet has already been filed in the case. Petitioner is 56 years old person and is suffering from several ailments. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the nature of accusation and the fact that the transaction in question is unethical and unlawful

Patna High Court CR. MISC. No.19784 of 2024(13) dt.26-09-2025 2/2 contract between the parties, coupled with the fact that the petitioner is 53 years old and is suffering from several ailments and charge sheet has already been submitted, provisional bail granted to the petitioner vide order dated 22.5.2024 is hereby confirmed.
