2. Petitioner apprehends his arrest in connection with Siwan P.S. Case No. 112 of 2024 registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act.

3. From perusal of the first information report as also the seizure list, it would appear that 1 liter of country made liquor was recovered from possession of two named accused persons being Arvind Kumar and Ritesh Kumar Paswan.

4. The learned counsel for the petitioner submits that so far as this petitioner is concerned, the name has transpired on account of he being the owner of the said motorcycle. However, the petitioner has made a specific statement in paragraph-7 of

Patna High Court CR. MISC. No.15326 of 2025(2) dt.02-04-2025 2/2 the petition that the said motorcycle had been taken away by the co-accused for the purposes of purchasing medicine but it may have been misused.

Considering the facts and circumstances and also considering that there is not recovery from conscious possession of the petitioner, I am inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, in the event of his arrest/ surrender within a period of four weeks from today the petitioner shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Siwan in Siwan P.S. Case No.112 of 2024, subject to condition as laid down under Section 438(2) of the Cr.P.C and subject to the further condition that the petitioner shall co-operate in investigation/ trial.
