JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-09-2017 The petitioner seeks regular bail in connection with Motipur P.S. Case No. 255 of 2017, registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 2 litres of foreign liquor. It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and though he is an accused in one more case but that is not of similar nature as the present one and he has been in judicial custody since 08.08.2017. Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and also that petitioner has criminal antecedent as he is an accused in one more as such, at present, I

No.45200 of 2017 (2) dt.15-09-2017 am not inclined to release the petitioner on bail, rather this application is disposed of with direction to the court below to release the petitioner once charge is framed in this case or petitioner completes four months in judicial custody, whichever is earlier.
