Petitioner seeks bail in a case registered for the offences punishable under Sections 363, 364, 302 and 201/34 of the Indian Penal Code.

According to FIR, the petitioner and four other named persons took the brother of the informant from his house and thereafter, the victim got missing and later on, dead body was found.

Submission is that the petitioner is in custody since 03.08.2018. Petitioner has got no criminal antecedent. The petitioner was never seen along with the deceased at any point of time by any other witness nor there is any motive against the petitioner. Similarly situated, co-accused, Sanjay Ram has been allowed bail by a Coordinate Bench of this Court vide order

Patna High Court CR. MISC. No.14069 of 2019(3) dt.14-05-2019 2/2 dated 27.03.2019 passed in Cr. Misc. No. 4895 of 2019. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr. No. 507 of 2018 arising out of Nokha Police Station Case No. 216 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
