The petitioner, apprehending his arrest in connection with Begusarai Muffasil P. S. Case No. 273 of 2013 registered for the offences punishable under Sections 304B, 201/ 34 of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act, seeks the privilege of pre-arrest bail.
Submission is that the petitioner is the father-in-law of the deceased and he has been living separately with his wife and similarly situated co-accused Nilima Devi, the wife of the petitioner has been allowed pre-arrest bail by another Bench of this Court vide Cr. Misc. No.18589/2014.
Patna High Court Cr.Misc. No.27433 of 2014 (4) dt.07-01-2015 2/2 considering that the petitioner is the father-in-law of the deceased and claims to have been living separately, the petitioner, above-named, is directed to be released on anticipatory bail in the event of his arrest or surrender within one month from the date of receipt/production of a copy of this order on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 273 of 2013 subject to the condition as laid down under Section 438(2) Cr. P.C.
