The petitioners are languishing in custody for the offences punishable under Sections 8(C)/20(B)/22/27(A) of the N.D.P.S. Act.

Submission is that recovery of narcotic Drugs (Ganja) is from the house of co-accused Bipin Bihari Singh and Mantu Kumar Singh and no recovery is there from the

Patna High Court Cr.Misc. No.23661 of 2018 (2) dt.25-04-2018 2 / 2 house/possession of this petitioners. Petitioners have got no criminal antecedent. Only material is confessional statement of co-accused Mantu Kumar Singh before the police. Similarly situated co-accused Bindhyachal Paswan has already been allowed bail by this Court in Cr. Misc. No. 19831 of 2018. Considering the aforesaid fact, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sheosagar (Baddi) P.S. Case No.391 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
