====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 18-10-2024 Heard learned counsel for the petitioner and learned APP for the State and learned counsel for the U.O.I./N.C.B..

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 20(b)(ii)(c), 25, 29 and 35 of the Narcotics Drugs and Psychotropic Substances Act, 1985.

3. As per the prosecution case, on a secret information, 702 Kg Ganja was allegedly recovered from the possession of co-accused Ravindrajeet.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has

He submits that the petitioner has no concern with the seized Ganja nor he was the owner the seized truck. He further submits that the petitioner is languishing in custody since 29.06.2022. The petitioner has one criminal antecedent of similar nature as mentioned in para-3 of this application.

A detailed counter affidavit has been filed on behalf of the U.O.I./N.C.B. in which it is stated that during the investigation of the case, the co-accused persons had categorically stated about involvement of the petitioner in the crime. Accordingly, a follow-up action was conducted against the petitioner Gurpreet Singh by the team of NCB, Amritsar and local Police of P.S.- Majitha, Amritsar, Punjab, on 08.06.2022. During the follow-up action, the joint team of local police and NCB, Amritsar reached the house of the accused petitioner Gurpreet Singh situated at Vill-Diddia, P.O.-Ludhar Kathunangal, Amritsar, Punjab-143502, from where he tried to escape and also attacked the joint team of police and NCB, Amritsar. An F.I.R. was lodged against him in PS-Majitha, Amritsar U/s 353, 186 & 332 of I.P.C. and sent to judicial custody.

6. Considering the facts and circumstances of the

Patna High Court CR. MISC. No.19722 of 2024(7) dt.18-10-2024 3/3 case and the nature of the offence, this Court is not inclined to grant regular bail to the petitioner. Accordingly, the prayer of regular bail of the petitioner is hereby rejected in connection with N.D.P.S. Case No. 21 of 2022, NCB Case No. 01 of 2022.

7. However, the learned Trial Court is directed to conclude the trial as expeditiously as possible preferably within a period of one year.
