JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 27-04-2015 The petitioner wants quashing of Annexure-12 which is an order of communication to the petitioner rejecting his claim for appointment as Counselor for S.T.D. The terms and conditions of the advertisement laid down various eligibility not only with regard to the subject but also with regard to the experience. No doubt, in order to support the persons with H.I.V. or AIDS working experience of one year in the field of H.I.V. and AIDS has been provided for but the finding is that the petitioner has no experience of that work in the

Patna High Court CWJC No.2596 of 2015 (4) dt.27-04-2015 area and that was the reason for his non-selection. The above position indicated in Annexures-12 has further been expanded and explained in the counter affidavit. If the petitioner has no minimum of eligibility, his non-selection which too on a contractual basis, cannot be said to be arbitrary and requires interference by this Court.

This writ application is, thus, dismissed.
