The petitioner apprehends arrest in a case under sections 323, 341, 379, 498-A, 504/34 of the Indian Penal Code. The informant Ranju Devi, has alleged in the F.I.R. that the petitioner and other family members of her Sasural used to torture and assault her for demand of dowry of rupees five lacs and also for land. It is further alleged that the victim was driven out from her Sasural due to non fulfillment of the dowry demand.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner
Patna High Court Cr.Misc. No.20554 of 2015 (2) dt.25-06-2015 had filed a divorce case being Matrimonial Case No. 55 of 2013 which is annexure-3 to the present application. In the said matrimonial case, a petition for maintenance was filed and as per order dated 26.02.2015, the informant is getting the maintenance of Rs.2000/- per month.
On behalf of the State, it has been submitted that the petitioner is the husband and is named in the F.I.R. Considering the facts aforesaid, in the event of arrest or surrender of the petitioner, above named, within four weeks from the date of receipt/production of a copy of this order, the court below shall enlarge him on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Bikramganj (Rohtas) in connection with Kachhawan P.S. Case No. 53 of 2013, subject to all the conditions laid down under section 438(2) of the Code of Criminal Procedure, 1973. (Sudhir Singh, J) Amin/- U
