Petitioner, already in custody since 12.01.2018, seeks bail in Kothi PS Case No. 60 of 2017 registered under Sections 147, 148, 149, 341, 342, 452, 323, 324, 325, 326, 354(B), 307, 337, 427, 379, 504 and 506 of the IPC and Sections 3⁄4 of Witch Practices Act. The allegation in brief is that large number of villagers assaulted the informant and looted some house hold articles alleging her as practicing witchcraft. Learned Counsel for the petitioner submits that the allegation is general and omnibus against large number of villagers and there is no specific allegation against the petitioner.

Patna High Court Cr.Misc. No.23696 of 2018 (2) dt.25-04-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kothi PS Case No. 60 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
