JUSTICE BIRENDRA KUMAR ORAL ORDER 30-04-2018 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners seek bail in a case registered for the offences punishable under Sections 363 of the Indian Penal Code.

Allegation is of kidnapping of the minor son of the informant. The victim has already been recovered. His statement under Section 164 of Cr.P.C was recorded wherein he had identified the petitioners as kidnappers. The petitioners are in custody since 27.02.2018.

Considering the entire facts and circumstances of the aforesaid case, let the petitioners, above named, be released on bail after completion of investigation on furnishing bail bonds of Rs.20,000/- (Twenty Thousand)

Patna High Court Cr.Misc. No.25765 of 2018 (2) dt.30-04-2018 each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Palasi Police Station Case No.244 of 2016, subject to the condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
