Petitioner, already in custody, seeks bail in connection with Bariarpur PS Case No.46 of 2015, registered under Sections 302, 201 and 120(B)/34 of the Indian Penal Code. Allegation in brief is that on account of land dispute with Karan Singh and Devkinandan Singh, the husband of the informant was killed and body was thrown in the river of Ganges.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR, there is no dispute with the petitioner rather the land dispute is with the FIR named accused persons, the petitioner was witness to the inquest of the deceased, merely on suspicion that he was also present at the
Patna High Court Cr.Misc. No.24478 of 2018(2) dt.25-04-2018 2/2 place of occurrence, he has been made accused, however, the petitioner has no criminal antecedent and FIR named accused Karan Singh has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No.30219 of 2015 on 11.08.2015. Having considered the aforesaid facts and circumstances, petitioner Surendra Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Munger in connection with Bariarpur PS Case No.46 of 2015.
