The petitioner apprehends his arrest in connection with Ara Town P.S. Case No. 146 of 2017 registered under Sections 406, 420 and 120(B)/34 of the Indian Penal Code. Allegation as per complaint petition is that the complainant and others have deposited money in D.J.N. group on the assurance that they will get 4 to 10% interest and after collecting the money, the F.I.R. named closed the office and misappropriated the amount.
Learned counsel for the petitioner submits that, in fact, the petitioner had filed the Complaint Case No. 1313C of 2016 in the court of C.J.M., Ara, on which basis present case
Patna High Court CR. MISC. No.21975 of 2019(4) dt.06-08-2019 2/2 was lodged but the petitioner has been made accused during investigation that he is one of the office bearer of D.J.N. group in which he is an investor.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara Town P.S. Case No. 146 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
