JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2020 The petitioner seeks bail in connection with Cheriyabariyarpur P.S. Case No. 193 of 2019 dated 22.12.2019 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act in which he is in custody since 23.12.2019.

It appears that 28.260 litres of liquor has been recovered from the possession of the petitioner. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated and the recovery said to have been made from him is a sham.

While saying so, this Court has taken note of the clean antecedents of the petitioner.

Considering the period of custody of the petitioner and the nature of accusation, he is directed to

Patna High Court CR. MISC. No.13199 of 2020(2) dt.02-03-2020 2/2 be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 2nd -cum-Special Judge, Excise, Begusarai in connection with Cheriyabariyarpur P.S. Case No. 193 of 2019.
