The petitioner seeks regular bail in connection with Special Case No. 112 of 2017 arising out of Pirbahore P.S. Case No. 361 of 2017 instituted for the offences under Sections 376 and 377 of the Indian Penal Code read with Sections 4 and 8 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 16.07.2017, is a person with clean antecedent and the trial has commenced. Learned counsel for the petitioner submits that till date only one witness has been examined and the witnesses are not coming forward in the trial. At this stage, learned counsel for the petitioner seeks permission to withdraw the present bail application with liberty

Patna High Court CR. MISC. No.33048 of 2021(4) dt.07-12-2021 2/2 to renew his prayer for bail in the event if the trial is not concluded within nine months from the date of receipt of a copy of this order.

Permission is accorded.
