06-03-2020 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Dhanarua P.S. Case No. 484 of 2019 registered for the offence under Section 307 & other allied sections of the Indian Penal Code. The prosecution case is that all the petitioners entered into the house of informant, misbehaved with ladies and on protest of the informant, they assaulted him and fled away by looting some money.

It is submitted on behalf of petitioners that petitioners are co-villagers of informant and dispute arose between parties over flow of drain water, due to which, they have falsely been implicated in this case. There is no

Patna High Court CR. MISC. No.13719 of 2020(2) dt.06-03-2020 2/2 direct allegation against the petitioners. It is further submitted that Section 307 of the Indian Penal Code does not apply against the petitioners. Petitioners are having no criminal antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Masaurhi (Patna) in connection with Dhanarua P.S. Case No. 484 of 2019, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
