JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 06-07-2020 Heard learned counsel for the petitioner as well as learned A.P.P. alongwith learned counsel for the informant. Being dispute marital in nature coupled with the fact that there was every possibility of settlement vide order dated 3.3.2020 the petitioner was granted provisional bail and further direction was given to the spouses to be physically present which could not be materialized in the background of prevailing Pandemic COVID-19, whereupon the same was extended vide order dated 13.5.2020. Needless to say, more than worse situation prevails.
In the aforesaid facts and circumstances of the case, one could not expect how much time the Pandemic will take in
Patna High Court CR. MISC. No.13364 of 2020(4) dt.06-07-2020 2/2 getting its subside. As such, the petitioner is directed to appear before the learned lower court where he will pray for appearance of O.P./ informant, after whose appearance learned lower court will endeavour to sort out the differences and will pass appropriate order. Till then, the petitioner will be at liberty to avail the liberty of provisional bail granted by this Court. In case, learned lower court will see that the matter is not being settled at the instance of the petitioner, then in that circumstance, will pass appropriate order in accordance with law.
