Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the OP No. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 498A and 34 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

In compliance of the order dated 13-8-2024, the petitioner and the OP No. 2 are present before this Court. 4.

Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case, being husband. It is also submitted that from perusal of allegation as

Patna High Court CR. MISC. No.17035 of 2024(4) dt.20-08-2024 2/2 alleged in the complaint, it would manifest that the allegations are also general and omnibus in nature. It is further submitted that petitioner also helped the OP No. 2 in getting her ANM course completed. It is next submitted that OP No. 2 has completed her course of ANM as such now she is not interested in reviving her conjugal relationship.

The OP No. 2, who is also present in the Court, submits that she does not intend to accompany the petitioner but then does not dispute that she has not completed the course of ANM.

After hearing the parties, the petitioner abovenamed, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 583C of 2022, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
