The petitioner seeks regular bail in Gopalganj P.S. Case No.211 of 2017 for the offence under Section 394 of I.P.C. and Section 27 of the Arms Act.

Allegation against the petitioner is under Section 394 of the I.P.C, though he is not named in the F.I.R. but his name transpires on the basis of spy appointed by the police. He is accused in five other cases.

Submission of the learned counsel for the Petitioner is that he is an employee of B.S.F. and he was on duty. It is further submitted that in all aforesaid cases he has been made accused on only suspicion.

Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.39232 of 2017 (2) dt.21-08-2017 2/2 Having heard both sides and in view of the facts and circumstances, as state above, I am not inclined to grant bail to the petitioner.Prayer for bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude as soon as possible, preferably within nine months from the date of receipt of a copy of this order, if the trial is not concluded within nine months, the petitioner may renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
