JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-12-2020 Heard Mr. Mithilesh Kumar Upadhyay, the learned counsel for the petitioner, Mr. Rishi Raj Sinha, the learned S.C.19 and Mr. Lala Purushottam Kumar Rajgrihar, the learned counsel appearing on behalf of the Accountant General through video conferencing.

The District Magistrate, Patna appeared through video conferencing and informed that Rs.3,20,000/- in the head of Leave Encashment and Rs.2,22,000/- in the head of Group Insurance have already been ordered to be paid to the petitioner on 02.12.2020. He personally undertakes to pay the remaining admitted retiral dues within two months from the date of this order.

Mr. Mithilesh Kumar Upadhyay, learned counsel for the petitioner submits that the petitioner joined on 16.07.2013 in the circle office of Dhanarua after being transferred. The petitioner is directed to appear before the District

Patna High Court CWJC No.5915 of 2019(10) dt.04-12-2020 2/2 Magistrate, Patna on 14.12.2020 at 11.00 A.M. and file representation with regard to his joining. The District Magistrate, Patna shall consider the entire facts after perusal of the records and pass appropriate order within two months from the date of filing of such representation. As has already been undertaken, the remaining amount of pension shall be paid within two months.

A supplementary affidavit is filed on behalf of the District Magistrate, Patna stating the facts that some payments have been made.

Let the same be kept on record.

Having considered the facts aforesaid, I dispose of this writ petition with liberty to the petitioner that if at all, the grievance of the petitioner is remained unredressed, the petitioner may approach this Court.

Personal appearance of the District Magistrate, Patna is dispensed with.
