The petitioner by way of this writ petition assails the order of the S.D.O., Jai Nagar, Madhubani, cancelling his license and also the order passed by the Collector, Madhubani, whereby the order passed by the S.D.O. has been confirmed. The license cancelled on the grounds have been approved. Learned counsel submits that the allegations against the petitioner are wholly flimsy and are not of such nature where the petitioner's license should have been cancelled.

3. I have considered the submissions and find that

Patna High Court CWJC No.4334 of 2023 dt.25-04-2023 2/2 the charge against the petitioner on inspection was that the food material supplied to him for distribution was found to be less by 6.26 quintals of wheat and 27.64 quintals of rice at the time of inspection which reflects that the ration had not been distributed to the consumers. Similarly, even the kerosene oil was not found to have been distributed to the consumers. The kerosene oil being distributed was at a higher price than the controlled price. The allegations have been found to be proved by the S.D.O. and the appellate authority has also found the charges to be true.

4. In view thereof, this Court finds that the charges which are of grave nature are sufficient to hold that the petitioner has not followed the conditions of license. The same has rightly been found by both the authorities to be sufficient for cancellation.

5. In view thereof, no interference is warranted. The writ petition is dismissed.
