This application, for grant of anticipatory bail, arises out of Ballia Police Station Case No. 211 of 2018, disclosing offences under Sections 341/323/379/504/506/354/34 of the Indian Penal Code.

There is allegation of assault made by the accused persons and of snatching valuables from the informant.

Patna High Court CR. MISC. No.15922 of 2019(2) dt.14-03-2019 2/3 Learned Counsel appearing on behalf of the petitioners has submitted that the parties are at litigating terms, which is evident from the First Information Report. He has also submitted that the First Information Report does not contain any reasonable explanation for delay of 12 days in registration of the First Information Report inasmuch as the occurrence is said to have taken place on 17.07.2018 to 18.07.2018, the First Information Report was registered on 29.07.2018. Considering the facts and circumstances of the case, this application is allowed.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Ballia Police Station Case No. 211 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions,
