2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Chapra Muffasil P.S. Case No. 654 of 2024 registered for the offence under Sections 103(1), 61(2) and 3(5) of B.N.S. Act.

3. In this case the name of the deceased is Raunak Kumar. Allegedly on 31.10.2024, he was murdered by some persons and his body was found near in the campus of Water Park situated at Mehiyan four lane. The informant is the mother of deceased. On the basis of information made by the informant, offence has been registered. During course of investigation, on the basis of confessional statement made by co-accused Anup Kumar, one mobile phone SIM number 7004455227 has been

4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner has not named in the FIR except, confessional statement made by coaccused Anup Kumar, there is no legal evidence available on record against present applicant. Regarding recovery of mobile phone is concerned, it is submitted by the counsel that there is also no evidence available on record, which shows that the said mobile phone has been used by the present applicant for committing the alleged crime. Petitioner is in custody since 12.11.2024 and charge-sheet has been filed, therefore it is prayed he may be granted benefit of bail.

5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.

6. Considering the above submissions made by the learned counsel for the petitioner and particularly considering the material available on record, I am of the view that the petitioner should be enlarged on bail.

7. Accordingly, the application is allowed.

8. The petitioner, above named, be released on bail
