The petitioner is languishing in custody for the offences punishable under Sections 363/366A/379/34 of the Indian Penal Code.
The FIR relates to kidnapping of the minor daughter of the informant. The victim has alleged kidnapping by the petitioner and others in her statement under Section 164 Cr.P.C. However, she has specifically stated that the kidnappers could not do anything else with her.
Submission of the learned counsel for the petitioner is that Annexure-3 series is photographs of the victim along with the petitioner which would show that the matter is of
Patna High Court Cr.Misc. No.25436 of 2018 (2) dt.27-04-2018 P2/ some affairs between the two and under pressure of the parents she had leveled allegation against the petitioner. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bihpur (Bhawanipur) P.S. Case No.470 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
