JUSTICE SANDEEP KUMAR ORAL ORDER 26-05-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Mahila (Banka) P.S. Case No. 53 of 2019 registered for the offence punishable under Sections 448, 376, 342, 506/34 of the Indian Penal Code.

It has been submitted by learned counsel for the petitioner that the petitioner and the victim girl have entered into a compromise and they are going to marry and a compromise petition has also been filed in the Court below. The certified copy of the compromise petition filed in the Court below has been produced by learned counsel for the petitioner, which is taken on record.

Patna High Court CR. MISC. No.15083 of 2022(2) dt.26-05-2022 2/2 Considering the aforesaid facts, this regular bail application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Banka, in connection with Mahila (Banka) P.S. Case No. 53 of 2019. However, before accepting the bail bonds of the petitioner the Court below will verify the genuineness of the compromise petition from the victim. If the victim supports the compromise petition then, the bail bonds of the petitioner shall be accepted. If the victim disputes the compromise petition, in such a situation, the bail bonds of the petitioner shall not be accepted.
