JUSTICE SANJAY PRIYA ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dalsingsarai P.S. Case No. 152 of 2017 instituted for the offence under Sections-307, 290, 291, 353 & other minor Sections of the Indian Penal Code. It is alleged that this petitioner was arrested on 21-05-2017 during election of Nagar Panchayat, 2017 as he was trying to disturb the polling in intoxicated condition. After his arrest, he raised Hulla and then several persons named in the written report, came to rescue the petitioner and pelted stones and bricks etc. on the police party, in which, two persons sustained injury.
From the written report itself, it appears that there is no specific allegation against the petitioner. In paragraph-3 of the petition, it has been mentioned that the petitioner has no criminal antecedent. In such circumstances, prayer for bail is allowed. The
Patna High Court Cr.Misc. No.37415 of 2017 (2) dt.08-08-2017 petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dalsingsarai P.S. Case No. 152 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Samastipur subject to condition that both the bailors should be close relative of the petitioner.
