ANJANA MISHRA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Kotwali P.S.Case No. 196 of 2014 registered under Sections 147, 148, 149, 307, 323, 504 and 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the FIR has been lodged after 12 days of the occurrence and no explanation has been offered by the informant for the delay in filing the same. Learned counsel further submits that so far as the allegation against the petitioner is concerned, he assaulted the informant with hockey stick.

Considering the nature of the allegation and the delay in filing the present case and also that the petitioner has got no

No.20441 of 2015 (2) dt.28-09-2015 criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S.Case No. 196 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
