Petitioners apprehend their arrest in a case filed under Sections 406 and 420 of the Indian Penal Code. It is contended that perusal of two complaints would reveal that petitioners' involvement except petitioner no.1 was only up to the stage of filling of form for the purpose of getting the loan for Animal Husbandry Department. So far allegation of fraudulently drawing Rs.2,30,000/- is concerned, it is against petitioner no.1, Bhulan Yadav.

Having regards to the facts and circumstances of

Patna High Court Cr.Misc. No.15975 of 2016 (2) dt.23-05-2016 2 / 2 the case, so far petitioner no.1, Bhulan Yadav is concerned, in view of the direct allegation of fraudulently drawing Rs.2,30000/- from the account of the complainant/informant, this Court would not be inclined to grant anticipatory bail to him. Accordingly, this application as against petitioner no.1 stands rejected. However so far petitioner nos. 2 to 5 are concerned, in the event of arrest/surrender within a period of six weeks from today in Buxar (T) P.S. Case No. 61/2016, the above petitioner nos.2, 3, 4 and 5 i.e., Ramdul Mahato, Muni Lal Singh, Yogendra Singh and Ravi Prasad respectively shall be released on bail on furnishing bail bond of Rs.10,000( Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
