The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 324, 307 & 506 of the Indian Penal Code and 27 of the Arms Act.

The Prosecution case in brief is that the accused persons fired as a result of which, the informant sustained fire arms injury.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 15-01-2019. Charge sheet has already been submitted. The petitioner has been falsely implicated in the present case. As per the

Patna High Court CR. MISC. No.15860 of 2019(3) dt.11-04-2019 2/2 allegation, co-accused Umar Ansari, Md. Alamgir and Abul Alam fired from their pistol. So far the petitioner is concerned, no allegation of assault is alleged against him. At best, he is a member of unlawful assembly. The petitioner undertakes that he will cooperate in trial.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 555 of 2018.
