The petitioner seeks bail in a case registered under Sections 395, 397 of the Indian Penal Code. Later on Section 414 of I.P.C. was added.

Allegation is that 25-30 unknown miscreants entered in the house of the informant after breaking open the door and committed dacoity. The accused persons looted 5 H.P. motors from the boring pump of Gahan Manjhi.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.12.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.14561 of 2020(2) dt.03-03-2020 2/2 in the present case. The petitioner is not named in the F.I.R. His name has come on confessional statement of co-accused. There is no recovery of any incriminating article from the possession of the petitioner. The petitioner has not been put on T.I.P. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate IXth, Gaya in connection with Magadh University P.S. case No.11 of 2002.
