Petitioner seeks bail in a case registered for the offence punishable under Sections 8/20/25/29 of N.D.P.S. Act. Earlier also, petitioner had moved this Court for grant of regular bail which was rejected vide Annexue 1. Allegation is recovery of 828 kgs. of Ganja from a truck in which petitioner and other co-accused persons were sitting. Petitioner has confessed his involvement in his statement recorded under Section 67 of N.D.P.S. Act.

Vide order dated 04.08.2021, a report was called from court below with regard to stage of trial. The report of the court below has come which is kept at Flag A in which it has been stated that all accused persons were not present on the date

Patna High Court CR. MISC. No.35116 of 2021(3) dt.29-09-2021 2/2 fixed for hearing, as such, bailable warrant has been issued by the court on 25.02.2020, due to which charges could not be framed.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected. However, the court below is directed to expedite and conclude the trial within one year from the date of receipt/production of the copy of the order passed by this Court. (S. Kumar, J) Sanjay/- U T
